BY USING AND MAKING ANY TRANSACTIONS ON THE WEBSITE YOU SIGNIFY YOUR AGREEMENT TO BE BOUND BY THESE TERMS.

 

Goods:

SimiWeave.com ("SimiWeave) specialises in new products and services (“Goods”) and its first is the SimiWeave™ (previously called NewHair®) range of products (hairpiece covering the head and made of human or synthetic hair) and accessories (shampoos, conditioners and other products produced for the maintenance of the pieces).

Orders:

All Orders placed on this Website will be subject to acceptance in accordance with these Terms. SimiWeave processes and dispatches orders on working days only defined as Mondays to Fridays 09.00 to 18.00 GMT (except for public holidays). When you place an order to purchase goods from SimiWeave you will be sent an e-mail confirming receipt of your order containing the details of your order. This email confirms acceptance of your order and the completion of the contract between you and SimiWeave. The email will be sent to the e-mail address you provide SimiWeave with on your order details. Whether or not you receive the e-mail, our acceptance of your order will create a contract between us.

Availability:

All goods are subject to availability. Any goods on the same order which have not been confirmed in an email do not form part of that contract. In the event that SimiWeave is unable to supply the goods, SimiWeave will inform you of this as soon as possible by email. A close alternative will be offered and, if appropriate, a back-in-stock date for the items you have ordered. If SimiWeave has to cancel your order, for whatever reason, it will be without charge to you and you will be informed of this by email.

Payment:

All transactions conducted on this Website are in GBP (£ sterling). SimiWeave cannot accept your order until you have paid for the goods in full (including VAT and all applicable delivery charges). The price for the goods is the price displayed on the Website at the time SimiWeave receives your Order, except in the following situation: While SimiWeave tries to ensure that all prices on the Website are accurate, errors may occur. If SimiWeave discovers an error in the price of the goods you have ordered SimiWeave will inform you as soon as possible by email and give you the option of reconfirming your order at the correct price or cancelling it. In this instance if you chose to cancel the order, you will receive a full refund. If SimiWeave is unable to contact you by email, SimiWeave will treat the order as cancelled and a full refund will be provided. Payment can be made by credit or debit card. Title in the goods you have ordered passes from SimiWeave to you upon dispatch of the goods, provided SimiWeave has received payment for the goods in full. The price for the goods is exclusive of delivery charges which will be added and are payable by you.

Dispatch & Delivery:

Whilst SimiWeave makes every effort to dispatch goods within the timescales published, all dispatch times stated by SimiWeave shall be treated by you as an estimate only. No liability can be accepted by SimiWeave for any delay or failure to dispatch the goods within the estimated timescale. Risk of loss or damage of goods passes to you on the date of when the goods are dispatched by SimiWeave. Delivery times and charges are set in line with the delivery times and charges offered by the UK's Royal Mail service and the other postal and delivery companies used by SimiWeave. Charges consist of (i) a standard administrative handling charge for each order which includes the cost of the packaging, and, (ii) the prevailing postage charge for signed-for delivery set by the Royal Mail and the other postal and delivery companies used by SimiWeave. Delivery charges will be confirmed at the time of order by email. SimiWeave shall deliver the goods to the address provided by you in your order details. Delivery by the UK's Royal Mail service and the other postal and delivery companies used by SimiWeave is always signed-for, and it is your responsibility to provide an address that is occupied during office hours (Mondays to Fridays 09.00 to 18.00 local time). If for any reason the delivery of the goods cannot be accepted at the time when goods are due, SimiWeave shall be under no obligation to track the delivery, arrange re-delivery or pay for the costs of re-delivery of the goods. SimiWeave will pass the costs of insuring the goods if they have to be held in storage to you. Although SimiWeave completes and submits a 'Customs Declaration and Dispatch Note' form with each international order and ensures that the addressee's telephone number is included with the delivery address where required, the clearing of and paying for customs, where randomly selected / required, is not the responsibility of SimiWeave. If for any reason the goods are not delivered by the postal and delivery companies used, other than provide a tracking number and proof of dispatch, SimiWeave shall be under no obligation to liaise with the postal and delivery companies to ascertain the location of the missing goods or to replace or refund the customer for the goods.

Disclaimer:

SimiWeave measures the length of the hair from the top of the head which is actually the correct way to measure hair. Other brands measure from the ear and this is why it may appear at first that the length on the hair on our products are shorter. Colours and the appearance of textures vary on screen from computer to computer so you may not be viewing a true representation of the actual colours or textures. The colours shown here are for reference only and are based on human hair wigs. Colours vary according to hair texture so will be different on the human hair to the synthetic hair pieces. Owing to the hand-made production of the pieces and the chemical processing - which are subject to environment conditions and fluctuations - that takes place to colour and texture the pieces, our pieces can vary from batch to batch in terms of length, colour, volume and texture. Occasionally we are able include a few extra inches of hair, for free, meaning that our products can also fluctuate in length from batch to batch.

Returns:

Owing to the hygienic nature of our SimiWeave™ hair products, we cannot accept returns or exchanges for any of them for whatever reason. Consequently refunds are only possible if you cancel your order before it has been dispatched. In such instances we will pass the transaction and administrative charges we would have incurred in processing your order and in processing your refund over to you, resulting in a 20% deduction from your refund. In the unlikely event that the goods are faulty, you have 30 days from the date of delivery to return the goods by signed-for postage in their original packaging and with a note containing your order number and clearly explaining the fault to SimiWeave.com. You must email customercare@simiweave.com before your return the goods and to receive the returns address (since this may differ from our registeredor mailing aaddress). SimiWeave will notify you of the receipt of your goods once by email and the conclusion of the assessment once by email. (If you do not receive an email from us, you can log in and track the status of the investigation at any time). Any correspondence in addition to these two emails will be at our discretion. The assessment can take up to several weeks as it may involve the need to send the goods to manufacturers for inspection. The conclusion will be either that (1) the goods were indeed faulty and alternatives or refunds will be offered and your postage for sending back the goods will be refunded; or (2) the goods were not found to be faulty and will be returned to you.

Liability:

Our human hair products are chemically processed for colour and texture. Therefore, SimiWeave does not recommend the use of perms, relaxers, colours, dyes, tints or any other form of chemical processing. SimiWeave will not assume any responsibility for any damages that might result from the use of perms, relaxers, colours, dyes, tints or any other form of chemical processing. Perms, relaxers, colours, dyes, tints or any other form of chemical processing must not be used on our synthetic hair pieces. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law. SimiWeave will not be liable in contract, tort, pre-contract or other representations or otherwise out of or in connection with these Terms for any: Economic loss (including without limitation loss of revenue, data, profits, contracts, business or anticipated savings); Loss of goodwill or reputation; Special or indirect losses suffered or incurred by that party arising out of or in connection with the provision of any of the matters under these Terms. The express provisions of these Terms are in place of all warranties, conditions, terms, undertakings and obligations implied by statute, common law, custom, trade usage, course of dealing or otherwise, all of which are excluded to the fullest extent permitted by law. Notwithstanding the above SimiWeave's aggregate liability whether in contract, tort or otherwise for loss of damage shall in any event be limited to a sum equal to the amount paid or payable by you for the goods in respect of the incident or series of incidents which are attributable to the same cause. We will not be liable for any delay or failure to meet our obligations under the Terms if such delay or failure is due to any cause beyond our reasonable control. The above does not affect your statutory rights as a consumer or your right to cancel. SimiWeave reserves the right to assign, transfer, or otherwise delegate (in whole or in part) the benefit of the rights under these Terms to any person.

The Website may contain Third Party advertisements. SimiWeave is not responsible for and does not endorse the content of such advertisements, and does not accept any responsibility for any errors or inaccuracies in such advertising material.

This Website may contain links to Third Party websites operated by parties other than SimiWeave. These links are provided for your convenience. When you activate one of them, you will leave the Website. SimiWeave has no control over, and will accept no responsibility or liability in respect of, material on any Third Party website. The customer acknowledges that all Intellectual Property Rights and/or proprietary rights relating to the products and the packaging are vested, and shall remain vested, in SimiWeave. The Website, and all the information and graphic representations or images on it ("Content"), are owned by, or licensed to SimiWeave. The copyright and all other intellectual property rights in the Content are the sole and exclusive property of SimiWeave or its licensors. You may view the Website on your computer screen and print its Contents on your printer for your personal and non-commercial use only, except that you may print Content off for the purpose of retaining evidence of any transaction you are entering into with us. For the avoidance of doubt, anything printed will form part of the Content. Save as stated above, without SimiWeave's written consent, you may not use, transfer, copy or reproduce any part of the Content, this Website or its source HTML code in whole or in part, in any form or by any means, electronic, mechanical or otherwise, except for the sole purpose of viewing its content. When you visit the Website or send e-mails to us, you are communicating with us electronically. SimiWeave communicates with you by e-mail or by posting notices on the Website. For contractual purposes, you consent to receive communications from SimiWeave electronically and you agree that all agreements, notices, disclosures and other communications that SimiWeave provides to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

 

Virus Protection, Security and Compatibility:

While certain precautions have been taken to detect computer viruses and ensure security, SimiWeave cannot guarantee or warrant that the Website, or the server of any other equipment or software, that makes the Website available, is virus-free and secure. SimiWeave shall not be liable for any loss or damage which occurs as a result of any virus or breach of security. SimiWeave does not give any warranties as to the compatibility of the Website with your computer systems, software and/or hardware.

Those who access this Website are responsible for compliance with local laws if and to the extent local laws are applicable. Any and all notices to be given by either one of us to the other pursuant to or in connection with these Terms shall be deemed sufficiently given when forwarded by e-mail or facsimile transmission in each case addressed to you at the e-mail address or facsimile number you have given us or to us at the e-mail address or facsimile number displayed on the Website. English law governs these terms and conditions. You submit to the exclusive jurisdiction of the English courts.
